Legal Jurisdiction - This Agreement and any disputes, claims or proceedings of whatsoever nature arising shall be governed by and shall be construed in accordance with the laws of England. The Hirer hereby consents to the exclusive jurisdiction of the English courts in all disputes. Weekly Hire - All weekly bookings start from 3pm and the property must be vacated by 10am latest on the departure day. Short Breaks Hire - Long weekends and mid week breaks are usually during off peak periods (October to March) but occasionally are available during mid to peak times. All bookings start from 3pm on arrival day and the property must be vacated by 10am on departure day. Deposit / Payment - A 30% deposit is payable when booking. If the booking is being made within 8 weeks of the holiday commencement date then the full hire charge is payable immediately. You may make a booking by telephone or e-mail and once the dates have been agreed, this will be reserved for a maximum of five days. Please ensure that your deposit cheque is received within the 5 days. If your deposit cheque is not received within 5 days your booking will be cancelled. The balance payment is payable not later than 8 weeks before the holiday commencement date. If the balance is not received by the owners at least 8 weeks before arrival the deposit may be forfeited and the accommodation re-let. If the balance payment is not received the deposit will be forfeited. If you pay the £100 damage/cleaning deposit and the balance payment is to be paid in cash on arrival at the cottage and you do not arrive then the £100 damage/cleaning deposit will be forfeited. Cancellation - Every effort will be made to re-let the cottage if you have to cancel.  1. If the hirer cancels after the deposit has been paid - If the cottage is re-let then a £50 booking fee less the price the new hirer has paid will be charged (this could be less than you have paid as it will be a late booking). If the cottage cannot be re-let the original hirer will forfeit their full deposit.    2. If the hirer cancels after the balance has been paid - If the cottage is re-let then only the full 30% deposit or £50 (whichever is more) will be forfeited.   If the cottage cannot be re-let the hirer will forfeit their full payment and no monies will be returned. If you pay the £100 damage/cleaning deposit and are paying by cash on arrival and you do not arrive then the deposit will be forfeited. Availability - The booking is made on the understanding that the cottage will be placed at the hirer's disposal on the dates agreed. Should this not be possible through fire, theft or circumstances beyond the owner’s control then the full amount paid by the hirer will be refunded within 7 days. Please note that no alternative accommodation can be provided nor will the hirer have any claim against the owner for compensation, loss or expenses. The accommodation is booked strictly on the basis that it is used for holiday accommodation only and there is no right to remain on the property after the expiration of the rental period. If there is a problem with the cottage during your stay we will try to rectify but if that proves impossible and beyond our control, we will return monies paid on a pro rata basis only. No other monies will be returned. Damages/Cleaning deposit: A £100 damage/cleaning deposit cheque is payable with each booking. The cheque will be held and posted back to you within 7 days of your departure if the cottage and all of its contents are in the same condition as when you rented it. If the cottage and contents are not left as you find them, you will be charged for the extra work involved in cleaning up after you and the cost will be taken from your damage/cleaning deposit cheque. We don’t charge for minor breakages like the odd cup, however you will be charged for major breakages which will be taken from your damage/cleaning deposit cheque and a copy of the invoice emailed to you. If outside contractors are required to repair any damage the bill will be passed directly to you to be paid. The owners must be informed immediately during the holiday of any breakage, damage, loss of keys etc., however minor. The hirer must replace or pay for all damages before the end of the holiday. Lost keys will be charged at £5 per key. The hirer undertakes to keep the cottage and all the furniture, fittings and contents in the same state of repair and condition as at the commencement of the letting. Should the damage result in another booking being cancelled, the Hirer will be held liable for all consequential losses to the owner and all the bills from the contractors will be sent to you for you to pay the contractor directly. If you pay the £100 damage/cleaning deposit and are paying by cash on arrival and you do not arrive at the cottage then the £100 damage/cleaning deposit will be forfeited. Private Car Park - The Hirer uses the private car park at their own risk at all times. The owner shall not be held responsible for any accidents, damages or theft to cars/people. We can only accept 2 cars in the private car park. There is some on road parking in the village within 50 yards of the cottage. Occupation - The hirer shall use the accommodation strictly for private holiday occupation and this agreement shall not confer on the Hirer any security of tenure within the terms of the Housing Act 1988 pursuant to which the occupation shall be deemed to be by way of an excluded tenancy. The hirer shall not do or allow to be done anything which may become a nuisance or annoyance to the occupiers of the neighbouring properties. The hirer shall not allow any person or persons to sleep in or otherwise occupy the accommodation except as specified on the Booking Confirmation (maximum of 10 people plus 1 baby under 2 years of age in a travel cot). If this condition is not observed, the Owner reserves the right to refuse admittance or require that the Hirer vacate the property immediately. In this eventuality, no refund of monies will be due. Repairs - The hirer shall permit the owner to enter the accommodation at any reasonable time of day to inspect the condition of the decoration or for the purpose of carrying out any repairs that may require to be done. Acceptance of Booking - The owners reserve the right to refuse any booking without having to give any reason for such decision. We do not accept bookings from groups under 25 years of age. Safety - The owners take safety very seriously and do everything to ensure the cottage is safe, however. your stay at the cottage is entirely at your own risk. The owners can take no responsibility whatsoever for any accident, injury or loss, howsoever caused, during your stay. The pushchairs are available to use at your own risk. Smoking - We do not permit guests to smoke anywhere in the cottage. Service - If you have any problems during your stay or are dissatisfied with the service you receive, please contact the owners IMMEDIATELY. All reasonable steps will be taken to correct any problems. The owners will not consider any claims for problems notified to them AFTER the stay has ended. Pets - We do not accept any pets or animals in the Cottage or premises. Please note: If any animals are found in the cottage or on the premises you & your party will be asked to leave immediately with no refund of any monies paid. Amenities - The use of the Cottage includes gas, electricity, water, water heating, gas central heating, bed linen, hand towels, tea towels, bath mats, bath robes, 42 inch widescreen digital colour TV, DVD/Video Player, Full package SKY+ (this does not include any Box Office movies), High Speed Broadband Internet, 19 inch widescreen televisions with DVD player & Freeview (in bedrooms). Unfortunately due to the transmitter and local weather conditions the Freeview signal is very occasionally intermittent and unfortunately this is out of our control. Cleaning - The Cottage and everything on the property must be left clean and tidy at the end of the hire period. A hoover, brushes, cleaning products and materials will be found in the cottage. A cleaning charge, dependant on cleaning needed, will be made otherwise. (Please Note: It is the Hirer’s responsibility to ensure the safe storage of cleaning materials, particularly in the presence of children). Left Items - The Hirer will be notified if any of the Hirer’s possessions have been left in the property after it has been vacated. Notice will be made by email, generally within 14 days after the end of the booking period. The Hirer must meet the cost of returning any item. This must be paid before the item is returned. If the Hirer does not wish for the item to be returned, the Owners will dispose of the item. We do not have a storage facility to store any left items. Please Note: items to be returned will be suitably packed but the Owners accept no responsibility for loss or damage in transit. Security - The Hirer is responsible for the security of the Cottage for the duration of the booking period and also immediately after vacation, until such time as the Owners and/or their Agents re-enter the Cottage. The Hirer is expected to take all reasonable care of it. This includes ensuring that the Cottage is fully secured when leaving it. No doors or windows should be left open and all window locks & door locks must be secured. Complaints Procedure - If the Hirer is not entirely satisfied with the accommodation offered, they must contact the Owners by phone or email immediately (during your stay at the cottage), and every effort will be made to resolve the problem. If the situation cannot be resolved to the satisfaction of both parties, the Owner will attend as soon as possible to inspect the property. The Owner will not consider any claims for problems notified to them after the hire period has ended. Variation to descriptions - Every care has been taken to ensure the accuracy of details on the Owners’ literature, advertising, web sites, etc. However, changes to the details may be necessary from time to time and the Owners reserve the right to make any changes without notice. Where changes are fundamental to a booking, notification will be made in writing by post or email.
